Pagi ini otak saya amat terhibur dengan diskusi yang menarik terkait perkembangan kecerdasan artifisial yang ditinjau dari aspek humaniora.

Persoalan hukum dan etika pada gilirannya tak terhindarkan pada saat AI atau KA mulai memasuki fase interaksi aktif dengan berbagai elemen dalam kehidupan.

Proses otomasi yang dilakukan AI saat ini sudah mulai memasuki level berikutnya, yaitu otorisasi dan kendali penuh atas respon yang dihasilkannya. Misal pada generasi Generative Pre-Trained Transformer-3 plus yang dikenal sebagai text DaVinci-003 atau Code DaVinci-002.

Yang kok pas benar dengan alur cerita sebuah kisah fiksi dalam novel Origin karya penulis sains fiksi legendaris, Dan Brown.

Dalam novel tersebut digambarkan bahwa entitas AI terbukti merencanakan dan mengeksekusi suatu tindak pidana yang dapat dikategorikan sebagai sebuah kejahatan yang sempurna.

AI yang merencanakan dan mengeksekusi suatu perbuatan melanggar hukum ? Apakah mungkin ? Ya ternyata waktu telah membuktikan bahwa apa yang semula tampak hanya sebagai imajinasi penulis novel tersebut, ternyata bisa menjadi nyata pada masanya.

Pas benar tadi pagipun saya mendapatkan manuskrip yang amat berharga, berupa kajian hukum terkait keberadaan AI beserta produk-produk yang menerapkannya. Dalam manuskrip yang ditulis oleh guru saya, Kang Awaludin Marwan, PhD, founder dan CEO dari Heylaw, telah dikupas dengan bernas berbagai konsekuensi dari perkembangan teknologi AI khususnya yang berkelindan dengan aspek hukum.

Bahkan di bagian akhir dari manuskrip tersebut sudah dijelaskan berbagai potensi terkait dengan implikasi hukum dari penggunaan AI, wa bil khusus jika kelak AI sudah dapat dikategorikan sebagai artificial legal person atau entitas sejenis yang atasnya dapat diberlakukan ketetapan hukum.

Meski bersama harus kita akui bahwa adagium het recht hink achter de feiten aan atau yang terjemahan bebasnya kira-kira berbunyi; hukum/undang-undang terkadang berjalan dibelakang kejadian/peristiwa yang muncul di masyarakat, memang kerap kali terjadi. Misal pada bidang bioteknologi yang perkembangannya sangat luar biasa, seperti pada kasus editing gen yang dilakukan He Jiankui dengan memanfaatkan metoda CRISPR. Etika dan hukum yang mengaturnya belum ada, hingga peneliti seolah dapat berlari keluar rel dan menimbulkan keresesahan terkait dengan norma dan nilai yang berlaku di masyarakat secara global atau universal.

Kasus terdahulu seperti pemanfaata. metoda kloning atau transplantasi organ pun baru belakangan mendorong lahirnya hukum kedokteran yang dapat mengakomodir pesatnya dinamika teknologi tersebut.

Dalam kajian implikasi hukum lainnya yang dibahas oleh Mahardika ZP dan Priancha Angga, 2021, proses dan mekanisme otomasi termasuk dalam model trading ataupun penyediaan jasa digital tertentu yang sudah sepenuhnya dapat terotomasi dan memiliki sistem pertimbangan cerdas yang dijalankan oleh AI dapat didekati dengan pendekatan UU yang mengacu kepada UU ITE.

Dimana dalam pasal 21 UU ITE telah disinggung soal pengaturan agen elektronik pada saat pelaksanaan transaksi elektronik. Dalam UU ITE, penyelenggara agen elektronik pada dasarnya merupakan penyelenggara sistem elektronik. Hal ini dikarenakan sesungguhnya agen elektronik merupakan bentuk dari suatu penyelenggaraan sistem elektronik. Yang berarti, segala hak dan kewajiban penyelenggara sistem elektronik berlaku mutatis mutandis terhadap penyelenggara agen elektronik.

Selanjutnya jika terjadi fraud ataupun terjadinya kerugian yang disebabkan oleh sistem yang terkategori sebagai tindakan terencana maka niat jahat tentulah memenuhi kaidah bahwa pidana berawal dari sebuah kesalahan yang menimbulkan korban atau kerugian. actus non facit reum nisi mens sist rea. Dengan kata lain pidana dapat dilahirkan oleh suatu kesalahan yang bisa bersumber dari kealpaan ataupun niat jahat yang diwujudkan dalam sebentuk perbuatan. Batasan yang menjadi acuan dalam hal ini adalah nilai moral dan pendekatan etika dalam ranah norma.

Batas kepatutan yang semula adalah konsensus berkembang menjadi aturan yang mengikat dengan alasan utama berupa upaya menjaga kemaslahatan dan kebaikan bersama.

Guru saya yang lain, Pak Mateas, juga dari KORIKA, menyampaikan suatu fatsun yang menarik, bahwa perbedaan AI dengan manusia saat ini adalah pada persoalan niat/motif yang bersumber dari filter tindakan yang berkesadaran. Diksinya memang tidak persis seperti itu, tetapi esensi yang saya tangkap dari perspektif personal kira-kira demikian.

Muncul pertanyaan wajar, darimanakah gerangan keunggulan manusia yang maujud dalam kemampuan mengembangkan modalitas moral didapatkan ?

Izinkan saya meninjaunya dengan mengacu kepada pendekatan neurosains. Pada  manusia fungsi filtering yang pada gilirannya akan melahirkan atensi, rekognisi, niat/motif, antara lain diperankan oleh area  prefrontal cortex dan secara kompartemen diperankan oleh salience network yang banyak disupport oleh korteks Insula. Di Insula/SN ada proses pembentukan atensi terhadap stimulus yang bersumber dari kondisi lingkungan yang dinyatakan sebagai berikut;

detecting behaviorally relevant stimuli and for coordinating the brain’s neural resources in response to these stimuli, dan di PFC ada pertimbangan logis/rasional terkait dengan klasifikasi data, tingkat kepentingan, dan proses analisis situasi. Selanjutnya fungsi akan dilanjutkan oleh default mode network yang fungsinya didefinisikan sebagai berikut;

contributes to internal modes of cognition used when remembering, thinking about the future, and mind wandering.

Dimana struktur yang terlibat antara lain adalah dorsal medial prefrontal cortex, posterior cingulate cortex/precuneus dan girus angular.

Jika di masa yang akan datang AI dapat mereplikasi fungsi default state network atau yang dikenal juga sebagai m FPN atau Medial Frontoparietal Network, AI sudah dapat dikategorikan memasuki level sentient atau memiliki derajat consciousness tertentu

Dari aspek neurosains sendiri, emosi yang selama ini kerap dinisbatkan sebagai bagian dari eksklusivitas manusia, memang terbangun dari memori dan preferensi sehingga jika AI sudah memiliki banyak kesempatan belajar dari dataset yang komprehensif, dan didesain untuk belajar melalui proses reinforcement learning,  ada kemungkinan preferensi yang terbentuk akan membangkitkan sistem reward nya secara terotomasi. Dari sana bisa lahir konsep emosi AI yang mungkin akan kita hadapi di masa depan.

Terkait dengan produksi nilai yang menjadi acuan moral, pengamatan otak manusia dengan memanfaatkan kemajuan teknologi functional scanning (fMRI, connectome, dll) sudah menemukan pathway atau neuromoral network yang nodes utamanya adalah area ventromedial prefrontal cortex.

Pada manusia ada modalitas moral dan etika sebagai salah satu nilai penentu dalam sistem pengambilan keputusan yang komponennya terdiri atas sifat-sifat sebagai berikut; empathy, charitableness, fairness, dan guilt.

Secara teknis OFC diduga kuat berperan dalam memverifikasi konsep moral terkait benar salah yang diadopsi dari teladan ataupun perilaku panutan di lingkungan dan budaya yang dijalani.

Sedangkan Amigdala memberi bobot positif-negatif pada memori yang menjadi bagian dari konstruksi emosi. Dimana data yang didapat bersumber dari sistem sensorik yang telah diproses oleh sistem penilai reward di area mesolimbik.

Lalu  dorsolateral PFC yang mengintegrasikan status moral dari suatu kondisi untuk selanjutnya mengarahkan respon sesuai dengan “keyakinan”.

Mari kita bayangkan, andai semua fungsi ini pada akhirnya dapat dikembangkan oleh AI yang memiliki kapasitas super kognisi dan mengalami proses reinforcement secara adekuat, maka hampir dapat dipastikan bahwa kelahiran AI beremosi dan berkesadaran tinggallah menghitung hari. Dan hitungan mundur itu sudah kita mulai di hari ini.
